Accusation
All license defense cases begin with service of the Accusation. The legal document acts as a pleading and is the first document filed in a license defense case. It gives the licensee (whether child care, RCFE or SMOG station) formal notice of the administrative proceeding to revoke the license. After receipt of the Accusation the licensee must file a Notice of Defense before the deadline to preserve their right to a formal administrative hearing. If the Notice of Defense is not filed by the deadline the licensee is deemed to have waived their right to a hearing and a Default Decision revoking the license will be issued.
