The License Revocation Process
There are certain events that forshadow an Administrative Action by Licensing to revoke a child care center license. First, Community Care Licensing will conduct frequent inspections. As a result of these inspections multiple Citations will be issued, and later used as evidence of general noncompliance with Title 22 and the Health and Safety Code. Second, a Non-compliance conference may be held to review the pattern of alleged deficiencies and non-compliance with Title 22 and the Health and Safety Code. Following the Non-compliance Conference the licensee may receive a letter from C.C.L. stating that the matter has been referred to Legal with C.C.L.’s recommendation that the license be revoked. Hiring an attorney at any of these early stages may be far less costly than hiring one after service of the Accusation seeking revocation of the Child Care Center Licensee.
Once these events have unfolded the licensee is usually served by mail or in person with an Accusation seeking revocation of the Child Care Center license. If a temporary suspension order is served along with the Accusation the licensee must cease operations immediately upon the effective date of the order. In that event, should the licensee file a Notice of Defense and request an Administrative Hearing, the hearing will be held within 30 days of filing the Notice of Defense.
Once served with the Accusation the licensee has an extremely limited amount of time to file a Notice of Defense. If the Notice of Defense is not timely filed the Department of Social Services will adopt an order revoking the license.
